Water use is an economic activity that involves the use of water resources to meet the needs of the population.

Special water use is a type of water use that provides for a certain way of using water resources in accordance with the conditions established by a special permit for the use of water resources.

The payment for special water use shall be made in accordance with the terms of the special water use permit, in accordance with Article 49 of the Water Code of Ukraine.

For water intake, you need permit for special water use, which is issued by an executive authority for a limited period of time. Depending on the term of the permit, special water use is divided into different types.

Individuals or legal entities consuming more than 5 m3/day of water must obtain such a permit.

Who issues a permit for special water use?

Permits for special water use are issued by the territorial bodies of the State Water Agency of Ukraine.

According to Article 50 of the Water Code of Ukraine, the validity of special water use is established by the authorities that issued the special water use permit.

In order to obtain the right to use groundwater, it is necessary to obtain approval from the State Service of Geology and Mineral Resources of Ukraine.

For the use of water bodies classified as therapeutic, approval from the Ministry of Health is required.

The special water use permit states: type of water use, type and characteristics of the equipment used, limits on water intake and wastewater discharge, conditions and restrictions under which special water use is permitted.

On 22 March 2019, an electronic service was launched in Ukraine that allows obtaining a permit for special water use.

At the same time, the process of obtaining and cancelling a special water use permit can be carried out online. To do this, an electronic application can be submitted on the electronic services portal of the State Agency of Water Resources using an electronic signature.

The procedure for issuing a permit for special water use

The water resources of Ukrainian rivers, lakes and other water bodies are subject to special water use, which requires a permit. The procedure for issuing such permits is regulated by the Water Code of Ukraine and the Resolution No. 321 on the Procedure for issuing permits for special water use, which was approved by the Cabinet of Ministers of Ukraine on 13 March 2002.

In order to obtain a special water use permit, a legal entity that plans to use water resources must submit an application together with the documents required for its consideration. These documents may include the following annexes:

  • justification of the need for water with a monthly normative calculation of water use and sewage;
  • description and diagram of water intake and discharge points;
  • standards for the permissible amount of dirty water discharged into water bodies, with a separate calculation for each discharge;
  • approved individual technological standards for the use of drinking water for enterprises, housing and communal services organisations and business entities providing centralised water supply and/or sewerage;
  • a copy of title documents for water bodies for persons using them on a lease basis.

You can apply for a special water use permit in the following ways: offline and online. Offline application must be submitted in person through the administrative service centre to the State Agency of Water Resources of Ukraine at the location of water bodies. Online application must be submitted through the electronic services portal of the State Agency of Water Resources using an electronic signature.

The State Agency of Water Resources considers the application, checks the documents on the possibility of special water use in the relevant water body, and makes a decision on issuing or refusing to grant a special water use permit.

The decision to grant a permit, in accordance with the procedure for obtaining a special water use permit, is made on the basis of the results of consideration of the application and documents, taking into account the minimum amount of water that should remain in rivers, lakes, reservoirs, etc. to ensure their ecological balance and functions. The decision also takes into account the rights to water use of other persons and national interests.

A permit for special water use is issued for a certain period of time and under certain conditions for the use of water resources. After the permit expires, it can be extended or a new special water use permit can be issued.

To proceed to the next stage, you must fill out an electronic application form that makes it as easy as possible to fill out using reference books and an interactive map. It allows you to fill in most of the information automatically.

The system will generate a completed form that corresponds to the prescribed form and provide an opportunity to verify all the data. In case of insufficient time to fill in the form or inaccuracies, the system allows you to edit and supplement the application form.

The next step is to sign the form with an electronic digital signature, after which an electronic application with the appropriate status will appear in the cabinet. This status makes it possible to track all movements of the application in the system.

After the application is received by the relevant territorial body of the State Agency of Water Resources, it is processed. If approval is required from the State Service of Geology and Mineral Resources or the Ministry of Health, the system allows you to save time and get approval from these authorities in parallel.

After passing the relevant approvals, the permit with the corresponding number appears in the cabinet. You can save it to your computer or print it out, if necessary.

Permit for special water use: price

The price of a special permit for water use depends on various factors, such as the type of water body, the volume of water to be used, the proportion of pollutant discharge etc. Certain types of special water use may be subject to special payments, for example, payments for the use of water bodies that are objects of the nature reserve fund.
