Holders of special permits for the use of subsoil, the type of which provides for geological exploration of a subsoil area, are required to register so-called form 3-gr – works and studies related to geological exploration.
This obligation is stipulated not only by the special conditions of the special permit, but also by Article 39 of the Subsoil Code and the Procedure for State Registration of Works and Studies Related to Geological Exploration of Subsoil, approved by Order of the Ministry of Ecology and Natural Resources of Ukraine №263 dated 14.06.2013.
What is form 3-gr and what is it for?
Form 3-gr is a mandatory document that certifies the subsoil user’s right to conduct works and studies related to geological exploration of subsoil and excludes the possibility of duplication of works on the same site.
By registering form 3-gr, you not only comply with the requirements of the law and the permit, but also secure the right to conduct geological exploration of the site. Thus, the procedure for registering a geological survey is an integral part of the subsoil user’s activities and an official evidence of the expediency of certain types and volumes of work to increase the geological, hydrogeological, engineering-geological, geophysical, environmental-geological and geochemical study of subsoil.
What works should a subsoil user register?
Subsoil users are required to register:
- prospecting works;
- exploration works;
- operational works;
- other works related to geological exploration of subsoil.
Work and research related to the geological study of the subsoil must be registered prior to their commencement and no later than one month after obtaining a special permit for subsoil use.
If, during the study of a subsoil site, a subsoil user identifies the need for additional (other) works subject to registration, he has the right to re-register the works.
Re-registration is also carried out in the following cases:
- name of the work and research related to the geological study of the subsoil;
- target task;
- area or district of work;
- term of work;
- extension of the boundaries of the subsoil use permit;
- the contractor (renewal of the special permit).
As for the re-registration of works, in accordance with the Procedure for State Registration of Works and Studies Related to Geological Exploration of Subsoil, a subsoil user submits documents for re-registration within one month. After that, the re-registered work receives a completely new registration number, and the previous one is considered invalid and canceled.
It is worth paying attention to the fact that the last re-registration of the work and research related to the geological study of the subsoil can be carried out no later than three months before the completion of work at the site. In case of temporary or final suspension of the work and research related to the geological study of the subsoil, the contractor is obliged to notify the State Service of Geology and Subsoil of Ukraine by sending a letter within fifteen days from the date of such decision.
How does the registration/re-registration procedure work?
Registration and re-registration of works is carried out by submitting an application to the State Service of Geology and Subsoil of Ukraine together with the documents attached thereto in electronic form through the Subsoil User’s Electronic Cabinet.
